Terms of Service

1. Agreement

By accessing or using Eight.ly software or services ("Services"), you agree to these Terms of Service. If you don't agree, don't use the Services. These terms apply to Eight.ly OS, sold as a Single licence or a Cluster licence.

2. Services

Eight.ly is self-hosted NAS and container management software, proprietary to Imogen Labs. We provide:

  • Eight.ly OS. Paid license, self-hosted, sold as a Single licence or a Cluster licence
  • Documentation — Available at wiki.eight.ly
  • Community support — Via Discord and GitHub Issues

3. License Grant

Eight.ly software is proprietary and confidential, and is licensed, not sold. Subject to your compliance with these Terms, Imogen Labs grants you a limited, non-exclusive, non-transferable license to install and use the Services on hardware you own or control, for your own internal use. This license does not grant you any right to copy, modify, merge, publish, distribute, sublicense, reverse-engineer, or sell copies of the software or its source code, in whole or in part. All rights not expressly granted in these Terms are reserved by Imogen Labs.

The Eight.ly installer is freely downloadable and may be installed and run without a license. A license is required only to receive software updates and to access the App Store — see Section 4.

4. License Terms

Eight.ly OS is sold as a Single licence or a Cluster licence. Buy once: a year of updates is included, with an optional yearly extension of updates, and Lifetime available (current pricing at eight.ly/pricing). Each license key is valid for one installation. Licenses are non-transferable and non-refundable after activation. Payments are processed by LemonSqueezy, our merchant of record.

5. Acceptable Use

You agree not to:

  • Redistribute license keys or circumvent license verification
  • Copy, redistribute, or resell the software outside these Terms
  • Use the Services for any unlawful purpose
  • Attempt to interfere with or disrupt the Services or related infrastructure
  • Misrepresent your identity or affiliation

6. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. We do not guarantee that the software will be error-free, uninterrupted, or fit for any particular purpose. You are responsible for your own data, backups, and system configuration. Eight.ly manages containers and storage on your hardware — any data loss resulting from misconfiguration or software bugs is your responsibility.

7. Limitation of Liability

To the maximum extent permitted by law, Imogen Labs and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising from your use of the Services.

8. Changes to Terms

We may update these terms from time to time. Continued use of the Services after changes constitutes acceptance. Material changes will be announced on our Discord and GitHub.
